The Board of Supervisors of Carroll County, Iowa met in regular adjourned session in the Boardroom of the Courthouse, in Carroll, Iowa, the County seat of said County on Tuesday, May 26, 2009 at 9:00 a.m. Central Daylight Saving Time pursuant to law, the rules of said Board and to the adjournment with the following members present: Marty Danzer, Dan Nieland, Mark Beardmore, Del McDermott, and Eugene Meiners.

Motion by Danzer, second by Nieland to approve the agenda with three additions: West Central Iowa Rural Water easement, FY10 Cost Report, and Virtual Servers update. On roll call, all voted aye.

Motion by Beardmore, second by McDermott to approve the minutes of the May 18, 2009 meeting as presented. On roll call, all voted aye.

Motion by McDermott, second by Danzer to approve claims for payment. On roll call, all voted aye.

Board reviewed two proposals for lawn seeding at Mallard View. NAT 4KE Lawn and Landscape submitted a bid of $4000 and Stan’s Lawn & Landscape submitted a bid of $3200. Motion by Nieland, second by Beardmore to accept the $3200 bid from Stan’s Lawn & Landscape. On roll call, all voted aye.

County Engineer proposed twelve drainage assessments, due to the number of drainage repairs caused by the large amount of rainfall last year. Motion by Meiners, second by Danzer to approve the following drainage assessments: 100% on Drain 10, 15% on Drain 14, 10% on Drain 24, 5% on Drain 31, 45% on Drain 47, 10% on Drain 50, 20% on Drain 51, 10% on Drain 67, 2% on Drain 106, 40% on Drain 88 North Main, 150% on Drain 88 South Branch 70, and 1% on Drain 88 South Main. On roll call, all voted aye. The Board will hold a joint meeting with Greene County, via a conference call, at 9:30 a.m. on May 28, 2009 to discuss an assessment for joint Drain No.86-150.

County Engineer presented a quote from Trans-Iowa Equipment, Inc. for two Wausau Model snow plows. They would be identical to snow plows the county already uses. Paulson would like to stay with the same brand of plows so parts can be interchanged. The quote was for $33,922 for two Wausau Model R4512 plows, plus $2,031 for two Model PW 10RH wings. This represents a 20% increase over the price of plows purchased in 2005. Motion by McDermott, second by Nieland to offer $33,922 for all parts of the package. On roll call, all voted aye. Paulson returned to the meeting later to inform the Board that Trans-Iowa Equipment, Inc. would lower the price by only $50. The Board asked Paulson to obtain another quote and reschedule the issue on next week’s agenda.

Dawn Mentzer met with the Board to review the FY10 Cost Report for Targeted Case Management Services. The expense total is $350,867, with 6,017 units of service. Case Management services will now be billed in 15 minute increments. All services will still be reimbursed, just in a different manner. Mentzer said this will involve a lot more paperwork and will be more time consuming. Motion by Nieland, second by Danzer to approve the FY10 Cost Report as presented. On roll call, all voted aye.

Mentzer reported the Case Management vehicle needs to have the windshield replaced. She also discussed the purchase of a new vehicle, which is included in the FY10 budget.

At 9:50 a.m. the Board held the second reading of Ordinance No. 31, an ordinance prohibiting the discharge of firearms on certain land controlled or managed by the Conservation Board. Nieland reported he had received questions about where the public can participate in paint-balling. Conservation Director, Mark River, said Mid-Prairie Park is where paint-balling activities should take place. Motion by Nieland, second by Danzer to approve the second reading of Ordinance No. 31 and to waive the third reading. On a roll call vote, Danzer, aye; Nieland, aye; Beardmore, aye; McDermott, aye; Meiners, aye; Motion carried unanimously. Ordinance No. 31 becomes effective upon publication.

River presented a limited easement for West Central Iowa Rural Water Association to run water pipelines through property owned by the Carroll County Conservation Board, an agency of Carroll County, Iowa. Motion by Nieland, second by Danzer to approve the limited easement for West Central Iowa Rural Water Association as presented. On roll call, all voted aye. Motion by Danzer, second by McDermott to approve Carroll County Resolution No. 2009-009. On a roll call vote, Danzer, aye; Nieland, aye; Beardmore, aye; McDermott, aye; Meiners, aye; Motion carried unanimously.

Carroll County Board of Supervisors
RESOLUTION ASKING FOR REVIEW OF THE DEFENSE OF MARRIAGE ACT BY THE IOWA LEGISLATURE AND THE PEOPLE OF IOWA

WHEREAS, the Iowa Legislature passed and the Governor signed in 1998 the Defense of Marriage Act, stating that marriage in Iowa is only between one man and one woman, and

WHEREAS, on April 3, 2009, the Iowa Supreme Court issued an opinion that is in conflict with that law, and

WHEREAS, Iowa Code Section 595.2 has not been amended or repealed, and
WHEREAS, the Iowa Legislature has the duty to check and balance the Iowa Judicial Branch,

NOW THEREFORE, BE IT RESOLVED that the Carroll County Board of Supervisors request that the Iowa Legislature resolve this issue by passing legislation that will lead to a public vote to amend the Iowa Constitution to provide that marriage in Iowa is only between one man and one woman.

Board reviewed manure management annual updates for Ryan Klocke, Section 21, Eden Township; Jason Klein, Section 13, Ewoldt Township; and Meyer 3, Section 14, Sheridan Township.

County IT Director, Carl Wilburn, reviewed proposals for the purchase of virtual servers. Five bids were acquired, and narrowed to three by Wilburn and Louie Grote. Wilburn, Grote, Meiners and Beardmore met to hear a presentation of the three proposals. The differences were mainly in hardware, some in software. Wilburn presented the Board with proposals from Alliance Technologies located in Des Moines. Wilburn recommended Option 1, which uses EqualLogic hardware and VMware software. The cost for this package is $63,396. A separate package for Imagetek, the equipment used by the county for scanned documents, has a cost of $10,218. The new equipment will allow the county to add virtual servers as needed, and will replace the six servers currently used by the county. Motion by Beardmore, second by Meiners to approve the purchase of Option 1 from Alliance Technologies, using available funds from the current year budget to pay for the EqualLogic hardware and VMware software, and purchasing Imagetek equipment in the next fiscal year. On roll call, all voted aye.

Danzer reported on Solid Waste meeting and gave an update on the Shooting Range.

Nieland gave an update on Mt. Carmel/Maple River sewer projects.

Beardmore reported on CACCC, Coalition for Human Services meeting, and virtual servers presentation.

McDermott reported on DECAT.

Meiners reported on CADC, New Opportunities and virtual servers presentation.

Motion by Beardmore, second by Danzer to adjourn at 10:52 a.m. On roll call, all voted aye.
