The Board of Supervisors of Carroll County, Iowa met in regular adjourned session in the Boardroom of the Courthouse, in Carroll, Iowa, the County seat of said County on Monday, July 27, 2015 at 9:00 a.m. Daylight Saving Time pursuant to law, the rules of said Board and to the adjournment with all members present: Neil Bock, District 1; Dean Schettler, District 2; Eugene Meiners, District 3; Marty Danzer, District 4; and Mark Beardmore, District 5.

Motion by Meiners, second by Bock to approve the agenda as presented with the addition of Manure Management Annual Update, Schon Farms, Section 11, Grant Township and Resolution 2015-019 Waiver of Right to Appeal. On roll call, all voted aye. Motion by Beardmore, second by Schettler to approve the minutes of the July 20, 2015 meeting as written. On roll call, all voted aye.

County Engineer Dave Paulson discussed Drain 52 in Section 24 Kniest Township. The drain is in need of repair and the work will be performed by Secondary Roads Department. Paulson discussed a drainage issue in Section 15 Jasper Township. Paulson will investigate it further and determine if the problem is in Drain 16 or Drain 30. Motion by Bock, second by Schettler to approve repairs to Drain 52 in Section 24 Kniest Township and either Drain 16 or 30 in Section 15 Jasper Township. On roll call, all voted aye.

Paulson discussed landowner requests to vacate a portion of Sherwood Avenue in Glidden Township Section 19. The Board set a public hearing on Monday, August 17th at 10:00 a.m. A decision on the request will be made after the public hearing. No formal action taken.

Paulson updated the Board on road projects. The project on N14 near Halbur was discussed. Meiners asked Paulson to look into additional repairs to areas of the roadway that are in need of repair. Paulson will contact the contractor and update the Board at a later date.

Motion by Schettler, second by Bock to approve payables for payment as presented with the exception of the Keltek bill, subject to further review. On roll call, all voted aye.

Motion by Meiners, second by Bock to approve plats of survey for Lot 3 SW1/4 NE1/4 Section 20-83-35, Lot 1 SE1/4 SE1/4 Section16-82-35 and Lot 1 SW1/4 SE1/4 Section 4-84-34.On a roll call, all voted aye.

Motion by Meiners, second by Schettler to approve Class “C” Beer Permit/Sunday Sales for Corner Station. On roll call, all voted aye.

Motion by Beardmore, second by Bock to approve FY15 Substance Abuse Prevention Report. On roll call, all voted aye except Meiners who abstained.

The Board reviewed two proposals to replace the kitchen exhaust hood at Mallard View. Motion by Meiners, second by Beardmore to accept the low bid from Drees Co. for $2,182 contingent upon verification that both proposals contained comparable equipment. On roll call, all voted aye.

Motion by Bock, second by Schettler to approve Homestead Exemptions Recommended for Allowance, Military Exemptions Recommended for Allowance, Homestead Exemptions Recommended for Disallowance, and Military Exemptions Recommended for Disallowance. On roll call, all voted aye.

Motion by Bock, second by Beardmore to approve applications from Richard P. Andersen, Dennis D. Frank, Tadd A. Haberl, Jerry Hargens, Mary K. Huff, Cynthia J. Klindt, Leo T. Renze, Ronald O. Roe, William J. Rupiper, Gary Schroer, and Terry W. Wright for Disabled Veteran’s Homestead Tax Credit. On roll call, all voted aye.

Board reviewed manure management annual updates for Blue Horizon Pork, Section 10, Wheatland Township; Nissly & Nissly, Inc., Nissly & Nissly Site 1, Section 32, Arcadia Township; Rodney Hinners, Karsten Site, Section 27, Ewoldt Township; and Schon Farms, Section 11, Grant Township.

Motion by Meiners, second by Schettler to approve Carroll County Resolution 2015-019. On a roll call vote, Danzer, aye; Beardmore, aye; Schettler, aye; Meiners, aye; Bock, aye. Motion carried unanimously.

CARROLL COUNTY RESOLUTION NO. 2015-019
APPROVAL OF WAIVER OF CARROLL COUNTY’S RIGHT TO APPEAL ISSUANCE OF FINAL CONSTRUCTION PERMIT FOR THE CONSTRUCTION OF CONFINED ANIMAL FEEDING OPERATION BY THE IOWA DEPARTMENT OF NATURAL RESOURCES.

BE IT RESOLVED by the Carroll County Board of Supervisors as follows:

Section 1. The Carroll County Board of Supervisors has received notice from the Iowa Department of Natural Resources (DNR) that the Pig Palace site has been issued a draft permit for the construction of a confined animal feeding operation building(s) in the SW ¼ SE ¼, Section 13, Jasper Township, in unincorporated Carroll County.

Section 2. The Carroll County Board of Supervisors reviewed the construction permit application and the manure management plan and determined that both appeared to be in compliance with the requirements of the Master Matrix, Iowa Code Section 459 and Iowa DNR rules and recommended approval of said application on June 29, 2015.

Section 3. The Carroll County Board of Supervisors hereby waives its right to appeal the issuance of the final permit within the fourteen (14) day limit from the time of receipt of notice of issuance of the draft permit.

Section 4. The Carroll County Board of Supervisors encourages the Iowa DNR to issue the Final Permit immediately upon notification of this waiver.

Section 5. The Carroll County Board of Supervisors authorizes the Board Chairman to notify the Iowa DNR of this waiver.

Section 6. This resolution shall take effect immediately.

Chairman opened a public hearing at 10:02 a.m. for consideration of a proposed change in an Urban Transition District from A-1 to B-1. The request was made by Gene Steffes to construct an office building in Section 21 Ewoldt Township. Planning and Zoning Director Carl Wilburn presented the Board with a letter from Iowa DNR and a copy of the approved Flood Plain Development Permit. Wilburn contacted the City of Manning and the adjacent land owners. Wilburn has received no comments on the proposed change. Following discussion the Board closed the public hearing at 10:14 a.m. Motion by Bock, second by Meiners to approve the use classification change from A-1 to B-1. On roll call, all voted aye.

Bock reported on DNR letter, County Attorney John Werden and Senate Judiciary Committee on Juveniles, Cadillac Tax on health insurance plans, Groups Services presentation, Iowa Works, County Block Grants, Chamber Coffee at Carroll Area Childcare Center, upcoming flood plain meeting, and CADC Housing Needs Assessment Study committee.

CADC Director Shannon Landauer met briefly with the Board to discuss the technical committee and presented the Board with minutes from a recent meeting.

Meiners reported on CADC meeting and ISAC Executive Board.

Schettler no official business.

Beardmore reported on Carroll Area Childcare Center Chamber Coffee and Tyler Technologies ongoing software negotiations.

Danzer reported on road ditches east of Coon Rapids, Westside State Bank open house, and local Hillary Clinton event.

Motion by Beardmore, second by Bock to adjourn at 10:37 a.m. On roll call, all voted aye.
